Your privacy is very important to Quick Load, LLC (d/b/a Quickload). This Privacy Policy describes the principles and practices that apply to Personal Information (defined below) collected from users of our services (“you”) on our Site (defined below), in telephone or e-mail communications, or in interviews or surveys.
Any use of this Site and the content derived therefrom is subject to this Policy. Quickload has created this Privacy Policy in order to explain our privacy practices and explain how we collect, use, share and protects user information. This Policy is only applicable to this Site. This Policy does not apply to third party websites, application, software or components that can be accessed or that are made available via links on the Site or through the use of the Services. This Policy should be read together with the Terms and Conditions of the Quickload Site and, in case of use of the Services, with the agreement between User and Quick Load.
Please read this Privacy Policy carefully. By using the Services and Site, you agree to and accept all of the terms and conditions set herein. If you are accepting these terms and conditions on behalf of a company or any other person, you represent and warrant that you have full authority to bind that company or person to these terms and conditions.
The remainder of this Privacy Policy describes our Personal Information handling practices in detail.
1. DEFINITIONS
In this Privacy Policy, terms that commence with a capital letter are defined in this Section.
“Guest” means an individual who searches our Services or our Site without being a User.
“User” means an entity that has registered on the www.quickload.com website or mobile application.
“User ID” means the username or identity Users use (with their password) to log into our Site.
“Quickload,”“us,” “our” or “we” means Quick Load, LLC (d/b/a Quickload) and its subsidiaries and affiliates.
“Personal Information” means any information, recorded in any form, about an identified entity, individual, or an entity or individual whose identity may be inferred from the information. This includes, for example, contact information, including but not limited to, your name and company name.[CP1] For motor carriers, further information may be required, including, but not limited to your MC number, certificates of insurance, copy of DOT authority, W-9 forms, and safety documentation.
“Services” means the arrangement of the transportation of cargo in interstate or intrastate commerce by an authorized motor carrier and other related functions available from our Site.
“Session Data” means usage and device information. This includes, for example, the type of Internet browser and operating system a Guest or User uses, the domain name of the site from which the Guest or User came, the date, time and duration of the Guest’s or User’s visit to our Site, the number of visits to our Site, the pages viewed on our Site, the cookies accumulated on the Guest’s or User’s browser, the type of mobile device the Guest or User uses and the unique identifier of a Guest’s or User’s mobile device.
“Site” means the www.quickload.com site or the mobile site and their respective sub sites together with the respective content, and the Services available from these sites or sub sites.
2. CONSENT
BY SUBMITTING PERSONAL INFORMATION TO US, AND/OR BY REGISTERING, ACCESSING, OR USING OUR SITE, YOU AGREE THAT WE MAY COLLECT, USE AND DISCLOSE SUCH PERSONAL INFORMATION AND SESSION DATA IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED BY LAW.
If you do not agree with these terms, do not provide any Personal Information to us and do not register, access, or use our Site. If you refuse or withdraw your consent, or if you choose not to provide us with any required Personal Information, we may not be able to provide you Services.
Minors
Minors (as defined under the laws of their jurisdiction or residence) are not eligible to use our Site, register for an account or request, order, or receive Services. We do not knowingly collect Personal Information from any Minor, and will not use this information if we discover that it has been provided by a Minor.
Services for Third Parties
If you request or order Services for third parties, you must make sure that you have the right to do so. By providing the Personal Information of any third party, you represent that you have all necessary authority and/or have obtained all necessary consents from such entity or individual to enable us to collect, use and disclose his or her Personal Information as set forth in this Privacy Policy.
3. WHAT PERSONAL INFORMATION WE COLLECT
We collect only such information as necessary to provide Services to you.
When you are just visiting
When you visit our Site as a Guest or User, we collect Session Data.
When using the Quickload mobile site and mobile app, you may request or order Services within a localized area. If you choose to do so, depending on the mobile device or application you are using, we may collect your geo-location information to provide Services. You may at any time disable our collection and use of your location information by turning location services off at the device level.
When you register as a User
When you register with us as a User, you must provide your name, telephone number, e-mail address, and shipper or motor carrier information, as applicable. You must choose a password, which will be required to gain access to portions of our Site reserved for User use. You may be required to provide additional information to request our Services, including, but not limited to, cargo and shipment information or specific certificates and permits.
When you use our Services as a User
When you use our Services as a User, you must provide payment and billing information and any other information that may be required or related to the Service, including, but not limited to, cargo and shipment information, and specific certificates and permits.
When you Request Services for a third party
When you request Services for a third party, you must provide that third party's name and contact information, payment and billing information and other information required to provide the Service.
When you participate in a survey, interview or a focus group
From time to time, we may invite you to participate in a survey or a focus group. You are free to participate or not. We will collect the responses you provide, and will make them anonymous by aggregating them with those of other participants.
When we advertise on third party sites
When you visit a site on which we advertise and click through our advertisement, we may place cookies on your computer or use pixel tags. The information that we collect through this technology is not personally identifiable.
When you call or write to our Customer Service
When you call or write to our Customer Service, we collect contact information, including, for example, name, phone number, e-mail or mailing address, and information about the relevant Service or shipment as necessary to assist you. For example, if you call for assistance with our Services or the Site, we may request your name, contact information and payment and billing information.
When we send e-mails or e-newsletters
In the event we send e-mails, we may insert a pixel tag in the e-mail to monitor those communications.
Information You Provide to Us.
We collect information you provide directly to us, such as when you create, modify, or log in to your account, request support from or otherwise communicate with us, and if you interact with the Services as a commercial driver or carrier dispatcher, submit your driver's license, submit information about your vehicle or insurance, or otherwise communicate with us. This information may include name, email, phone number, postal address, profile picture, payment information (bank account, routing number, ABA), vehicle registration information, insurance information, driver's license information, and other information you may choose to provide.
Information We Collect Through Your Use of the Services
Depending on how you use the Services, we may collect information about you in the following general categories:
Location Information (commercial drivers and carriers only)
Use of the Services requires collection of commercial drivers' precise location data. If you (as a commercial driver for a carrier) grant Quick Load LLC permission to access location services through the permission system used by your mobile operating system ('platform'), we will collect the precise location of your device. We may also derive your approximate location from your IP address or phone number. We may also receive information about your location from third parties.
Device Information
We may collect information about the device you use to access the QuickLoad app, including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
4. HOW SE USE THE INFORMATION WE COLLECT
We use Personal Information in order to provide the Services, including, but not limited to, the following:
- To provide access to the Quick Load website and applications;
- To enforce our Terms of Service;
- To process user registration with the Services;
- To provide users with information, administrative notices and bulletins, and communications relevant to user accounts and services;
- For fulfillment of the Agreement;
- For billing, invoicing, identification and authentication, and fraud prevention;
- For internal billing purposes;
- To facilitate the provision of Quick Load Services;
- To accommodate inquiries and requests;
- For purposes provided in the cookie policy;
- For troubleshooting problems, market research, and detecting and protecting against error, fraud, or criminal activity;
- For distribution to carriers providing transportation services through Quick Load;
- For shippers seeking and receiving services though Quick Load;
- To aggregate visitor statistics in connection with the use of the Services;
- To diagnose problems with our computer server; and
- As otherwise set forth within this Privacy Policy
In addition, tracking information may be collected when using the Services, in particular geographic location. GPS coordinates of the shipments being transported through the use of our Services are sent directly to our servers. This information is used to provide Users with support, notify carriers when shipments are available for pickup, and inform consignees and receivers of arrival times, inform shippers of the location of a dispatched load, and for our internal business purposes.
Session Data
We use Session Data to better understand how our Site is navigated to and used, so we can improve our Site’s content and ease of use, personalize and improve viewing experiences on our Site and provide relevant information. We may use service providers to collect Session Data on our behalf. You may opt-out of certain Session Data being collected while you are using a mobile device.
Pixel Tags
We use pixel tags to monitor the open rate of our communications. This helps us understand the effectiveness of communications we send. We do not use this information for any other purpose.
Survey and Focus Groups
In the event you participate in surveys or focus groups, your participation and responses will be kept confidential and will not be shared with third parties without your permission.
Aggregated Information
Aggregated information is information recorded in any form about more than one entity or individual, where the identity of the entity or individual is not known and cannot be inferred from the information. We may use aggregated information to describe our user base to current or potential partners, current or potential users, investors and advertisers; after a survey, to understand and respond to market needs and preferences; or to make recommendations to other users of our Site.
What we do NOT do
We do not and will not, at any time, request your payment or billing information, User ID, password or national or state identification numbers in a non-secure or unsolicited e-mail or telephone communication.
Identity theft and the practice currently known as “phishing” are of great concern to us. Safeguarding information to help protect you from identity theft is our priority. For more information about phishing, you may want to visit the Federal Trade Commission website.
5. TO WHOM WE DISCLOSE PERSONAL INFORMATION
From time to time, we may disclose your Personal Information as follows:
- When third party carriers and shippers provide services through Quickload user information may be provided, only to the extent necessary to carry out or receiver the services being provided;
- When Quickload is required to provide information in response to a subpoena, court order, to other applicable law or legal process;
- When Quickload has a good faith belief that disclosure is necessary to prevent or respond to fraud, or to protect the rights, property or safety of Quickload, users, and others;
- If Quickload merges or is acquired by another company, is part of a sale of assets user information may be disclosed and/or transferred to tan acquirer, or successor or assignee;
- In the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets;
- When information such as name, email address, and bank account information is collected during the sign up process, we may share the it with third party service providers, such as payment providers.
Although Quickload does not generally disclose personal information to third parties, Quickload is not responsible for any issues that may arise regarding the Privacy Policy of any such third parties. By consenting to this Policy, you hereby agree to release and to hold Quickload harmless from any claims and/or damages that may arise from the actions of third parties.
National Security
In order to protect national security, the United States Government and other governments may request access to shipment information and records, which typically includes party names, shipment origin, destination, duration of transportation, form of payment, credit card numbers, addresses, and telephone numbers. In response to such request, Quickload will give access to all the information you provide at the time of use of the Services to the applicable government agencies.
6. HOW WE RETAIN AND STORE PERSONAL INFORMATION
If you are a User, you can access your account from the home page of our Site, after logging onto our Site. Your “My Shipments” page contains information about your current, canceled or past use of the Services. Your account page also contains your name, e-mail address, e-mail and password settings. It may also contain other information so that you do not need to re-enter it each time you use the Services. For example, your account page may contain your billing information unless you tell us not to store it.
You can access, modify or close your account as described in How to access, modify, or close your account.
Retention and Storage
We will retain your Personal Information in our databases in accordance with our Records Management Policy and applicable laws. This period may extend beyond the end of your relationship with us, but it will be only as long as it is necessary for us to have sufficient information to respond to any issues that may arise later. We may also need to retain certain information to prevent fraudulent activity; protect ourselves against liability, permit us to pursue available remedies or limit any damages that we may sustain; or if we believe in good faith that a law, regulation, rule or guideline requires it.
Your Personal Information will be stored in secured locations and on servers as described in How we protect Personal Information.
7. HOW WE PROTECT PERSONAL INFORMATION
Quickload employs physical, administrative and technical safeguards to help protect the confidentiality and integrity of Personal Information and to reduce the risk of loss, misuse, unauthorized access, disclosure or modification of Personal Information. When Personal Information is sent to our Users, we require in our contracts with them that they protect all Personal Information in a manner consistent with the principles articulated in this Privacy Policy.
If you choose to contact Quickload through our Site, you should be aware that any information transmitted electronically via the World Wide Web might not be secure. Quickload assumes no liability for the loss of any information that you transmit to us via the World Wide Web. However, if you provide your credit card information on our Site’s credit card forms, we encrypt the transmission of that information using secure socket layer technology (SSL).
In communicating with you, we may send e-mail as unencrypted plain text because we are aware that most Users and Guests cannot readily process encrypted e-mail. This is done for your convenience, but with the security concern that, if misrouted or intercepted, it could be read more easily than encrypted e-mail.
8. HOW TO ACCESS, MODIFY OR CLOSE YOUR ACCOUNT
We endeavor to ensure that Personal Information is as accurate, complete and current as necessary for the purposes for which we use that information. We encourage you to visit your account to review your Personal Information. You can access your Personal Information and update it or delete inaccuracies, as necessary.
If you wish to close your account, you can do so by contacting us as indicated in Contact Information. We will respond to such requests within 30 days following receipt at the e-mail or mailing address stated above. If we receive your request at a different e-mail or mailing address, we will respond within a reasonable period of time, but not to exceed 150 days from the date received. If you request that we close your account, we will promptly do so, to the extent possible. Once your account is closed, however, you will not be able to use many of the services available on our Site to Users, unless you re-register.
Please remember that we may not be able to honor your request if we are legally obligated to retain information, or for other reasons described in Retention and Storage.
9. PRIVACY COOKIES AND PIXEL TAGS
A cookie is a small text file that our computer sends to your computer, and that your computer sends back to us each time you make a request from our Site. A cookie contains a unique identification number that identifies the visitor's browser, but not necessarily the visitor. A pixel tag is a small graphic image similar to a cookie.
When you access our Site, we may place cookies, pixel tags or other code on your computer to collect Session Data. These technologies are used to help us recognize you when you visit our Site again or to help us customize your online experience. Unless you specifically inform us of your identity (e.g., by registering with us or signing into your account using your account credentials), we will not know who you are.
Most Internet browsers automatically accept cookies. You can instruct your browser, by editing its options, to stop accepting cookies or prompt you before accepting a cookie from the sites you visit.
If you decide not to accept our cookies, you will be able to access those parts of our Site that are available to the general public, but you may not be able to access many of our Services.
Third Party Advertisers
Opting-Out
As part of the registration process we give you the ability to receive commercial communications about Products and Services, updates to our Site and customized advertisements and promotions that are targeted to your specific interests. We send these communications directly ourselves or via third party service providers. If you do not opt-out from receiving these communications, we will send them to you. At any time you may change your selection to receive or not receive these by changing your preferences. In addition, these communications will include instructions on how to unsubscribe.
Monitoring
Quickload may from time to time monitor and review any information transmitted or received through our Site, or through telephone or e-mail communications, for quality assurance and other purposes. We reserve the right to censor, edit, remove or prohibit the transmission or receipt of any information that Quickload deems inappropriate or in violation of our Site Terms of Service. During monitoring the information may be examined, recorded or copied.
10. CHANGES TO THE PRIVACY POLICY AND CHANGES IN OWNERSHIP
We may change or supplement this Privacy Policy from time to time. Privacy Policy changes will apply to the information collected from the date we post the revised Privacy Policy to our Site, as well as to existing information held by us.
Please revisit this page periodically to stay aware of any changes. If we decide to change this policy in a material way, we will obtain the necessary consents required under applicable privacy laws if we seek to collect, use or disclose Personal Information for purposes other than those to which consent has been obtained, unless otherwise required or permitted by law. If any proposed change is unacceptable to you, you may request that we close your account.
11. DISPUTES
Quickload understands that the security of your personal information is important, and therefore, provides commercially reasonable administrative, technical, and physical security controls implemented to protect personal information of all its users. Notwithstanding, Quickload hereby disclaims any liability for any unauthorized access to or use of our servers and/or personal or financial information stored therein. Further, Quick Load cannot ensure or warrant the security of any information transmitted to us or received from us or through one of our applications and disclaims any responsibility for or liability related to loss or damage of whatever nature due to harmful programs received from this site or by means of files downloaded from this site. By consenting to this Policy, you hereby agree to release Quickload from any liability and to hold Quickload harmless for any damages that may result therefrom.
